1. AGREEMENT
These Terms of Service ("Terms") govern your use of the website fastsba.com (the "Site") and the services offered through it, operated by Fast SBA LLC ("Fast SBA", "we", "us", "our"). By using the Site or submitting information through any form on it, you agree to these Terms. If you do not agree, do not use the Site.
2. WHAT FAST SBA IS – AND IS NOT
Fast SBA is a free matching and referral service for small businesses seeking financing. We are NOT a lender, bank, broker-dealer, or loan servicer, and we do not make credit decisions, offer loans, or guarantee that any loan will be offered or funded. The Site is not affiliated with, endorsed by, or acting on behalf of the U.S. Small Business Administration or any government agency. "SBA" loan programs are offered by participating lenders, not by us.
When you submit information through the Site, we review it and may match you with one or more independent lenders or financing partners in our network ("Partners"). Any financing discussions, terms, approvals, or agreements happen solely between you and the Partner. We are not a party to any agreement you enter into with a Partner.
3. NO GUARANTEES
We do not guarantee:
– that you will be matched with any Partner;
– that any Partner will approve, offer, or fund a loan;
– any particular rates, terms, amounts, or timelines.
Any rate ranges, eligibility criteria, or program descriptions on the Site are general educational information only and may not reflect what any Partner offers you.
4. ELIGIBILITY
You must be at least 18 years old and authorized to act on behalf of the business whose information you submit. By submitting business information, you represent that you are authorized to share it and that it is accurate to the best of your knowledge.
5. INFORMATION YOU PROVIDE
You agree that the information you submit (including your name, business name, contact details, revenue, and funding needs) is accurate and current. You authorize us to:
– review your information to assess potential matches;
– share your information with Partners we believe may fit your needs, so they can contact you about their products;
– retain your information as described in our Privacy Policy.
Submitting information is free and creates no obligation to accept any offer.
6. COMMUNICATIONS CONSENT
By submitting a form on the Site and providing your email address and/or phone number, you expressly consent to be contacted by Fast SBA and by Partners we match you with, at the email address and phone number you provide, including by email, phone call, and text message (including messages sent using an automatic telephone dialing system or prerecorded voice, where permitted by law). Message and data rates may apply. Consent to receive calls or texts is not a condition of using the Site or of obtaining financing. You may withdraw consent at any time by replying STOP to a text message, using an unsubscribe link in an email, or contacting us at info@fastsba.com.
7. NO PROFESSIONAL ADVICE
Content on the Site (guides, blog posts, eligibility descriptions) is general information for small businesses. It is not legal, tax, accounting, or financial advice, and it does not create an advisor-client relationship. Consult a qualified professional about your specific situation.
8. INTELLECTUAL PROPERTY
The Site and its content (text, design, logos, graphics) are owned by or licensed to Fast SBA and protected by applicable law. You may view and print pages for your own business use. You may not copy, republish, or reuse Site content commercially without our written permission.
9. THIRD PARTIES
The Site may link to third-party websites and may connect you with third-party Partners. We do not control and are not responsible for third-party sites, products, services, privacy practices, or lending decisions. Your dealings with any Partner are solely between you and that Partner.
10. DISCLAIMERS
The Site and our matching service are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or secure.
11. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Fast SBA and its owners, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any lost profits, lost revenue, or lost business opportunities, arising out of or related to your use of the Site, any match we make, or any dealings between you and a Partner. Our total liability for any claim related to the Site or our services will not exceed one hundred US dollars ($100).
12. INDEMNIFICATION
You agree to indemnify and hold harmless Fast SBA from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your submission of inaccurate or unauthorized information, or your dealings with any Partner.
13. GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of the State of New York, without regard of conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be resolved in the state or federal courts located in New York, New York, and you consent to their jurisdiction.
14. CHANGES
We may update these Terms at any time by posting a revised version on the Site with a new "last updated" date. Continued use of the Site after a change means you accept the updated Terms.
